G. W. Capps: Acquitted of Assault.
REARDAN, Wash., Dec, 18.—-George W. Capps, an old-timer, was acquitted today in justice court on a charge of assault. The complaint was made by J. J. McGillicuddy, manager of the Western Talc Mines, north of Mondovi on the Spokane river. Capps is the owner of the mine and some years ago leased it to the Western talc company, a Seattle corporation. Capps has opposed the work because the company, he alleges, has not fulfilled its agreement. Capps came upon McGillicuddy and two men opening a new prospect. Capps used threatening and abusive language and brandished an ax, so McGillcuddy testified in court, but his testimony was not corroborated.
