BOOZE HEARING DELAYED AGAIN

WALLACE, Idaho, Aug. 25.—District Judge A. H. Featherstone today sustained the defense demurrer to the complaint in the case of the state of Idaho against John Pavelich and Elmer L. Hardesty, operators of the Smeliterville beer parlor, an action in which the state seeks to abate the establishment as the result of an alleged violation of the Idaho liquor code.

The defendants had been cited into court to show cause why they should not be temporarily enjoined from operating. In today’s ruling the court gave the state five days in which to file an amended complaint.
